You agree to use the Device as per these terms and conditions. If you violate of the terms, it will constitute both a breach in the guarantee provided with the device and not make us liable to any action or claim, even by third parties against you or the product. Conditions for Usage:
You agree that you will comply with all statutory provisions relating to wireless telegraphy, and that specifically, the Device shall not be used for any immoral or unlawful purpose, and will provide us or its authorized agent with all necessary information as reasonably requested for, and will indemnify us against every liability cost or claim or loss that we incur or may incur as a result of the failure by you, or anyone on its behalf, to comply with this condition.
You will not tamper with the seal as provided on the Device. Any tampering of the seal shall constitute breach of these terms as well as breach of the warranty provided along with the Device.
You will not tamper with the SIM card, which is part of the device and owned by us. We are not liable to any unauthorized usage of the SIM, you will pay the charges for the same.
You must use your tracking system, SIM card and the service in the exact manner as described in the User Guide or other instructions issued by us.
If the SIM card is used for any other purpose, including changing its IP address which is prohibited, then in such situation you shall be responsible and liable for all the usage, and shall make required payments applicable in relation to the SIM card.
It is understood by you that the Device is associated with services based on third-party service providers, including mobile network providers. We shall not be liable in case the Device functioning is not proper or is defected either because of any such third-party service provider, or due to external factors which could affect the overall reception of the network to the Device.
We do not warrant uninterrupted or error-free operation of the Device, we will however do our best to ensure operation is smooth and error-free. If any errors occur on our side, we will make sure the error is corrected promptly.
You shall pay all the necessary installation and maintenance charges in relation to the Device and We shall not be liable for any of the same.
You may return any Product that you have purchased within 7 working days of delivery, for any genuine reason and to do so, you must notify us, in writing or by other durable medium (including e-mail), within those 7 working days only. You will then be entitled to a refund from us, which will be paid as soon as possible, but in any event within a period of 30 days. Return Policy:
You must arrange for and pay the costs of returning the Devices to Us. While in your possession, you must keep any Devices you intend to return to us in good condition. If: (a) the Device delivered is not what you ordered (including any Substitute Devices), or does not correspond with its description; (b) the Device delivered is not of a satisfactory quality; or (c) the Devce is not fit for any other purpose for which you have bought it and you notified us of this purpose before purchase, and the we had not informed you that the Device is not fit for that purpose; we will, at its option, deliver to you a replacement device or refund to you the price paid and your reasonable costs of returning the Devices. The return request will be accepted only if the device is in its original state, with the seal and cables intact.
The device will reach the customer within 4-10 days depending on the area of shipping, the PIN Code as well as the courier company that is delivering it to the customer. Delivery / Shipping Policy:
1) Returns/ cancellations of any TrakingPro device order are possible only for the first 3 days after purchase; the customer will receive a full refund within these 3 days. After 3 days if a cancellation is made, the courier charges for both the receiving and sending of the package will be deducted, and the rest of the amount paid by the customer will be refunded. Return & Refund Policy of TrakingPro:
2) If the device gets damaged, either physically or technically, on the way, and the customer receives it damaged, then the customer must return the device, and it will be replaced within 7 days.
The term of this contract is the same as the Device. The term of the Device with guarantee period starts on the date of installation of the Device in the vehicle and becomes active.
Term of Contract:
The device, and any software used along with it, are provided "as is" without any representation or warranty of any kind, including, but not limited to, warranties of merchantability, non-infringement, or fitness for any particular purpose. There is no warranty of any kind, express or implied, regarding third-party content. Usage of this device does not guarantee that the vehicle shall be completely safe from theft, burglary, break-in, or any other tampering with the vehicle.
Any damage injury caused by any failure of performance, mobile network, SIM card error, or defect, delay in operation or transmission, computer virus, communication line failure, theft, destruction or unauthorized access to the alteration of, or use of record, whether for breach of contract, tortuous behavior, negligence is not liable to TrakingPro or any of its affiliates. We are not liable to any damages- direct or indirect
Policies about Damages:
These terms and conditions shall be governed by and construed in accordance with the laws of India and the courts in Kolkata, West Bengal shall have exclusive jurisdiction to deal with the controversy or claims or actions arising out of this Agreement.
The above Terms and Conditions may change from time to time, and we have sole discretion to change them with or with notifying you first.
